USER AGREEMENT
Welcome to Advantage! Every new member must agree to abide by the terms of the user agreement. The following agreement informs you of the services you can expect from us and expectations we have of you.
THIS AGREEMENT governs your use of the Advantage website. By using or visiting our website, you accept the Terms of Use. If you do not agree to the Terms of Use, you should not use the Advantage website.
Advantage is a members-only rental service provider of educational multimedia products. Our goal is to help individuals and organizations make informed decisions about education and work. We provide information for life’s transitions.
In order to rent items from Advantage, members must meet the following requirements:
Members control their own account via "Account Summary.” As an Advantage member, you may change or discontinue your account at any time. We reserve the right to modify, suspend or terminate access to the service on the Advantage website at any time for any reason without notice or refund. We also reserve the right to delete all data files associated with your account and/or other information you have on our website.
Copyright/Public Performance Rights: All Advantage programs grant public performance rights as long as no fees are charged. Programs are licensed for direct play only, not for open broadcast, CCTV, ITFS or other forms of distribution. Duplication is strictly prohibited by federal copyright regulations.
Delivery and Return of Rented Products: We use the U.S. Postal Service (USPS), postage prepaid, to track delivery and return the items you rented. Actual delivery times may vary and depend on inventory availability, date of order, your delivery address, and circumstances impacting delivery by the USPS.
Cancellations: You may cancel your subscription to Advantage at any time. To cancel, call 800/745-5480 and a customer service representative will assist you, or email us at actadvantage@act.org. We do not provide refunds or credits for partial subscription periods. Upon cancellation, you will be given ten (10) days to return any outstanding rentals. Failure to return such rentals will result in an invoice charge on your credit card for such items.
Changes to Terms of Use: Advantage reserves the right, from time to time, with or without notice to you, to change these Terms of Use. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" hyperlink on the Advantage website. The most current version of the Terms of Use will replace of all previous versions.
Fees and Payment: Advantage will charge you a membership fee as selected and maintained by you (“Account Summary”). All payments will process through a valid credit card. You can cancel your account at any time, but you will remain liable for all charges. We reserve the right to change our fees at any time for any reason, but, whenever possible, we will give you at least one month's advance notice of such change. All fees and charges are nonrefundable. Advantage does not store credit card information in your Account Summary. Sales tax will be charged to Kansas residents and to those members whose states require the collection of sales tax on this membership service. We will strive to include those additional states as they are identified.
Damaged Rental Items: If you receive a defective item, please call 800/745-5480 immediately and a customer service representative will arrange to have a replacement item sent to you.
Lost Items: If after 10 business days (Sundays not included) from placing your order, the package has not arrived, please call customer service at 800/745-5480 and we will attempt to track your package. If we are unable to locate the package, we will send you a replacement shipment. If the original shipment arrives in addition to the replacement, please send one of the shipments back as soon as possible.
Lost Returned Items: To ensure that you are not charged for a package that might be lost by the U.S. Postal Service (USPS), we highly recommend that you mail the package from your local post office. The post office will scan the return label, activating the tracking mechanism, and provide you with a Merchandise Return Mailing Acknowledgement. If the package is lost and you have the Merchandise Return Mailing Acknowledgement or if the return package has been scanned into the USPS system, you will not be charged for the lost item(s). If there is no proof of mailing, however, you could be charged for the lost item(s). The return package can be placed into your mailbox for your mail carrier to pick up. However, for your protection, this is not the preferred return method because it does not provide tracking and proof of mailing.
Extended Rentals: Extended rentals are permissible; however, to avoid any confusion about missing returns, we recommend that you contact us about your intent to extend your rental. Items not returned by their due date will automatically generate a re-rental charge to your account and you will have use of the product for an additional 15 days. Items not returned within five (5) days after one re-rental period without intervention from the member will be considered lost and your account will be invoiced the retail cost for the item(s) less the re-rental fee and including any applicable taxes. The item(s) are now the property of the member.
Purchased items for which a member has been invoiced can be returned for a partial refund within 10 days of the invoice date. A $3.00 per item restocking fee will apply. Members should contact customer service immediately if their intent is to return the items within 10 days.
Web Site Rules: You agree to abide by certain rules that are important to enable the proper use of the Advantage website and ensure members' protection. Any member's failure to follow these rules, whether listed below in the contract or at various points in the program, may result in termination of that member's Advantage account.
1) Do not tell others your password or let others use your membership account.
2) Do not attempt to log in more than once at the same time on any given account.
3) With regard to “member reviews”, while you should feel free to express yourself, you should respect other users of the program.
4) Advantage reserves the right to remove or edit content at any time without notice.
Indemnity: You shall defend and indemnify Advantage and hold Advantage harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including reasonable attorneys' fees), relating to any acts by you or materials or information transmitted by you in connection with the Advantage website, leading wholly or partially to claims against Advantage or our website by other subscribers or third parties, regardless of the type of claim or the nature of the cause of action.
Disclaimers of Warranty: Advantage assumes no liability or responsibility for any errors or omissions in the content of the Advantage website, any failures, delays, or interruptions in the shipment of products, delivery of any content contained on the Advantage website, any losses or damages arising from the use of the content provided on the Advantage website, or any conduct by users of the Advantage website. Advantage reserves the right to ship merchandise at our sole discretion.
Under no circumstances shall Advantage or its officers, managing members, or employees be held liable for any loss or damage caused by your reliance on information obtained through the Advantage website. It is your responsibility to evaluate the information, opinion, advice, or other content available through the Advantage website.
Advantage is providing this website and its contents "as is" and makes no representations or warranties of any kind with respect to this website or its contents. Advantage disclaims all such representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose or use, non-infringement, and condition. In addition, Advantage does not represent or warrant that the information accessible via this site is accurate, complete or current. Price and availability information is subject to change without notice.
In no event shall Advantage be liable for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of this information. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states liability is limited to the greatest extent permitted by law.

In addition, other websites may link to the Advantage website. Advantage has not reviewed these websites and is not responsible for the content or privacy policies of these websites.
Termination of Usage: Advantage may terminate User access, or suspend any User's access to all or part of Advantage without notice, for any conduct that Advantage, at its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another User, a third-party Provider, a Merchant, a Sponsor, a Licensor, a service provider or Advantage.
Copyrights: All content included on the Advantage website, including text, website design, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, the selection and arrangement thereof, and all software, is the property of Advantage or its suppliers and is protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of Advantage and protected by U.S. and international copyright laws. They should not be reproduced or used—including reproduction for purposes of modification, distribution, or republication—without express written permission from Advantage.

Advantage Ordering and Privacy Policies
Before placing an order, you must first become a member. Click on the "Join Today" button. You will be asked to fill out some basic information about yourself including your name, shipping/billing information (address, city, state and zip code), a daytime telephone number, and your credit card information. We accept American Express, Discover/Novus, MasterCard and VISA. The most convenient way to order products from Advantage is online ordering. You can now select a product directly from our online library and have it shipped directly to you. To start this service, simply do a product search for the subject area that interests you. When you have the search results, click the "Add to Cart" button that appears to the right of the title.The second method of ordering product from Advantage is to call our customer service department at 800/745-5480.

Advantage provides electronic commerce as an optional service and convenience to our customers. All users of this service do so at their sole risk and without any representations, warranties, or assurances by Advantage regarding the security of the information that is provided as part of the electronic commerce (including credit card information) or the timeliness or effectiveness of the delivery of purchased items. When you order services through us, such as membership, we ask for your credit card information for payment purposes. The Advantage website may contain links to other sites. ACT is not responsible for the privacy practices or the content of such sites. It is your responsibility to check the policy statement of such other sites to understand their policies. In interacting with such sites, you may be sharing your private information. It is your responsibility to keep such information private and confidential.
Opt-Out
If at any time after registering you decide you do not want to receive promotional information from ACT or our partners, you can disable this benefit by unchecking the opt-in checkboxes on the Edit Address section of the Account Summary page after logging in.
Privacy Policy Changes
Advantage shall have the right to change this Privacy Policy at any time. Advantage will post any changes here so that our users will know what information Advantage gathers, how it might use that information and whether it will disclose such information to anyone.
